Agreement

By visiting sammyai.app, joining the waitlist, or using the Sammy app when it launches, you agree to these terms. The site and the app are operated by Keep DS Pty Ltd (“Keep DS”, “we”, “us”), an Australian company based in Richmond, Victoria.

If you do not agree, please do not use the site or the app.

Eligibility

Sammy is intended for users 18 years and over. You must be old enough to enter a binding contract in your country of residence to use the service or join the waitlist.

What Sammy Is

Sammy is an AI personal assistant that runs on your phone. There are three tiers when the app launches:

Free - runs entirely on your device using Google’s open-source Gemma model. No internet required.
Core - adds Sammy Cloud for faster, more capable responses. Sammy Cloud runs on a decentralised GPU network rather than a single tech-giant data centre.
Premium - adds Specialist modes powered by Anthropic’s Claude, plus a meaningfully higher monthly usage allowance.

The app is launching first on iPhone, with Android to follow. There is no “bring your own API key” option. We route to providers on your behalf and pay them ourselves out of your subscription.

AI Models and Outputs

Depending on the tier and the request, Sammy uses one or more of the following models:

Google Gemma, on your device.
Sammy Cloud models, running on a decentralised GPU network.
Anthropic’s Claude, for Specialist modes on Premium.
Google Gemini, for image generation on Core and Premium.

AI-generated content can be wrong, biased, or out of date. Treat Sammy as a thinking partner, not as a source of professional advice. Always review what Sammy produces before relying on it for medical, legal, financial, or other consequential decisions.

We do not guarantee that any particular model will continue to be available on any tier. The mix of models may change as the field evolves.

Subscriptions and Billing

Free Sammy is free to use. Core and Premium are paid subscriptions, billed monthly or yearly through Apple’s App Store (and Google Play when Android launches). Prices are shown in your local currency on the pricing page. The store you bought through manages your billing, renewals, and refunds. Cancel any time from your device’s subscription settings.

Each paid tier includes a sensible monthly usage allowance. If you reach the cap, Sammy will let you know and either fall back to on-device, wait until your allowance resets, or offer you the option to upgrade. We will never silently bill you extra.

Acceptable Use

Don’t use Sammy:

To do anything illegal, or to ask Sammy to help you do anything illegal.
To harass, threaten, defraud, or harm other people.
To produce sexual content involving minors, or any other content prohibited by the underlying model providers.
To attempt to extract another user’s data, reverse engineer the service, or interfere with how it runs for others.

We may suspend or terminate accounts that violate these rules.

Your Data

How we handle your data is described in detail in our Privacy Policy. The short version: we don’t sell your data, we don’t train AI models on your conversations, and conversations live on your phone by default.

Warranty Disclaimer and Liability

The service is provided “as is”. We don’t guarantee it will be uninterrupted, error-free, or that AI outputs will be accurate. To the extent permitted by Australian Consumer Law and other mandatory consumer protections in your country, our liability is limited to the amount you have paid us in the 12 months before the claim.

Nothing in these terms excludes rights you have under non-excludable consumer laws.

Changes to These Terms

We may update these terms over time. If we make material changes, we’ll let you know via the app or email and give you a chance to review them. Continued use after a change means you accept the new terms.

Governing Law

These terms are governed by the laws of Victoria, Australia. Disputes will be heard in the courts of Victoria, except where mandatory consumer law in your country requires otherwise.
