Terms of Service

Welcome to Sammy. These Terms of Service (“Terms”) are an agreement between you and Keep DS Pty Ltd (ABN 91 695 408 756) (“Keep DS”, “we”, “us”), an Australian company based in Richmond, Victoria, governing your use of the Sammy app and related services (the “Service”). By using Sammy, you agree to these Terms.
1. Who can use Sammy
You must be at least 18 years old to use Sammy. By using the Service you confirm that you meet this requirement.
2. The Service
Sammy is a personal AI assistant. It can run in two ways:
- On-device mode, where a local model processes your requests entirely on your iPhone or iPad. Your conversations are not sent to us in this mode.
- Sammy Cloud mode, where your requests are sent to our cloud to be processed by AI models on your behalf. Cloud features may require a paid plan.
3. Your account
Some features require an account. You are responsible for keeping your login credentials secure and for activity that happens under your account. You can sign in with email, Apple, or Google.
4. Subscriptions and billing
Sammy offers free and paid plans (Core and Premium). Paid plans are sold as auto-renewing subscriptions through your Apple App Store account.
- Payment is charged to your Apple ID at confirmation of purchase.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
- You manage and cancel subscriptions in your Apple ID settings; we cannot cancel them for you.
- Except where required by law, payments are non-refundable; refunds are handled by Apple under their policies.
5. Acceptable use
You agree not to use Sammy to break the law, harm others, infringe intellectual property, attempt to disrupt or reverse-engineer the Service, or generate content that is illegal or abusive. We may suspend or end access that violates these Terms.
6. AI output
Sammy’s responses are generated by AI and may be inaccurate, incomplete, or out of date. They are not professional advice (legal, medical, financial, or otherwise). Use your own judgement and verify anything important before relying on it.
7. Your content
You keep ownership of the content you put into Sammy. You grant us the limited rights needed to operate the Service for you, for example sending a message to the cloud to generate a reply, or storing your data so the app works. We do not sell your content, and we do not use your conversations to train AI models.
8. Third-party services
Sammy works with third parties such as Apple, Google, and our cloud infrastructure and model providers. Your use of those services is also subject to their terms. Integrations you connect (for example Google Calendar or Drive) are accessed only to provide the features you ask for.
9. Changes and termination
We may update the Service and these Terms over time; we will update the “last updated” date when we do. You may stop using Sammy at any time and can delete your account and data from within the app.
10. Disclaimers and liability
The Service is provided “as is” without warranties of any kind, and AI outputs may be inaccurate. Nothing in these Terms excludes rights you have under non-excludable consumer laws, including the Australian Consumer Law. To the extent permitted by law, our total liability is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect or consequential damages.
11. Governing law
These Terms are governed by the laws of Victoria, Australia, except where mandatory consumer law in your country requires otherwise.
